MYSA-AJAX Terms and Conditions

Effective Date: July 18, 2025

1. Introduction

Welcome to the Modesto Youth Soccer Association-Ajax United ("MYSA-AJAX," "we," "our," or "us"). These Terms and Conditions ("Terms" or "Agreement") govern your use of our website (www.mysa-ajax.org), services, programs, and any other content provided in connection with our organization (collectively, the "Services").

By accessing or using our Services, registering for programs, or participating in any MYSA-AJAX activities, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use our Services or participate in our programs.

MYSA-AJAX reserves the right to modify these Terms at any time. Any changes will be posted on our website and will be effective immediately upon posting. Your continued use of our Services after any changes constitutes acceptance of the modified Terms.

PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS IMPORTANT PROVISIONS REGARDING LIABILITY, INDEMNIFICATION, AND DISPUTE RESOLUTION.

2. About MYSA-AJAX

MYSA-AJAX is a nonprofit youth soccer organization serving the Modesto, California area. We provide recreational and competitive soccer programs for youth players ages 4-18, as well as adult leagues. Our mission is to promote the game of soccer in a spirit of teamwork, fair play, and sportsmanship while fostering interest in soccer in the greater Modesto area.

3. Eligibility and Registration

A. Age Requirements

  • Youth programs are open to players ages 4-18
  • Adult programs are open to players 18 and older
  • Minors under 18 must have parent/guardian consent to participate

B. Registration Requirements

To register for our programs, you must:

  • Provide accurate and complete information
  • Submit all required documentation (birth certificates, medical forms, etc.)
  • Pay applicable fees
  • Agree to abide by all rules and regulations
  • Maintain current contact information

C. Medical Clearance

All participants must:

  • Submit current medical clearance forms
  • Disclose any medical conditions that may affect participation
  • Provide emergency contact information
  • Maintain current insurance coverage

4. Program Participation

A. Code of Conduct

All participants, parents, and spectators must:

  • Demonstrate good sportsmanship at all times
  • Respect referees, coaches, players, and officials
  • Follow all facility rules and regulations
  • Refrain from use of profanity, inappropriate behavior, or unsportsmanlike conduct
  • Comply with all applicable laws and regulations

B. Equipment and Safety

Participants must:

  • Wear appropriate soccer attire and protective equipment
  • Use only approved equipment during games and practices
  • Follow all safety guidelines and instructions
  • Report any unsafe conditions immediately

C. Attendance and Commitment

  • Regular attendance at practices and games is expected
  • Advance notice is required for absences when possible
  • Excessive absences may result in reduced playing time or removal from team

5. Fees and Payments

A. Registration Fees

  • All fees must be paid in full before participation begins
  • Payment plans may be available upon request
  • Registration fees are non-refundable except as provided in Section 5.C

B. Additional Costs

Additional costs may include:

  • Uniforms and equipment
  • Tournament fees
  • Travel expenses
  • Referee fees
  • Facility usage fees

C. Refund Policy

  • Refunds will only be provided for program cancellations by MYSA-AJAX
  • Medical withdrawals may be eligible for prorated refunds with proper documentation
  • No refunds will be provided for disciplinary removals or voluntary withdrawals
  • Processing fees may apply to approved refunds

6. Intellectual Property

A. MYSA-AJAX Content

All content on our website and materials, including logos, trademarks, text, graphics, and photographs, are owned by MYSA-AJAX or used with permission. You may not reproduce, distribute, or modify any content without written permission.

B. User-Generated Content

By submitting photos, videos, or other content to MYSA-AJAX, you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content for promotional purposes.

C. Photography and Video

MYSA-AJAX may take photographs and videos during activities for promotional purposes. By participating in our programs, you consent to such use unless you provide written notification otherwise.

7. Liability and Risk

A. Assumption of Risk

Participation in soccer activities involves inherent risks including, but not limited to:

  • Physical injury from contact with other players
  • Injuries from falls or collisions
  • Weather-related hazards
  • Equipment-related injuries
  • Facility-related hazards

By participating in MYSA-AJAX programs, you acknowledge and assume these risks.

B. Release of Liability

To the fullest extent permitted by law, participants and parents/guardians release MYSA-AJAX, its board members, coaches, volunteers, and affiliates from any liability for injuries or damages arising from participation in our programs, except for gross negligence or willful misconduct.

C. Medical Treatment Authorization

In case of injury or medical emergency, MYSA-AJAX is authorized to secure necessary medical treatment for participants. All medical expenses are the responsibility of the participant or parent/guardian.

8. Insurance

A. Required Coverage

All participants must maintain current medical insurance coverage. Proof of insurance may be required.

B. MYSA-AJAX Insurance

MYSA-AJAX maintains general liability insurance. This coverage is secondary to participant's personal insurance and does not cover all potential claims.

9. Disciplinary Actions

A. Grounds for Discipline

Disciplinary action may be taken for:

  • Violation of code of conduct
  • Unsportsmanlike behavior
  • Failure to follow rules and regulations
  • Non-payment of fees
  • Providing false information

B. Disciplinary Measures

Disciplinary actions may include:

  • Verbal or written warnings
  • Suspension from activities
  • Removal from programs
  • Permanent ban from MYSA-AJAX activities

C. Appeals Process

Participants may appeal disciplinary actions by submitting a written request to the MYSA-AJAX Board of Directors within 14 days of the disciplinary action.

10. Website and Technology Use

A. Acceptable Use

When using our website or technology services, you agree to:

  • Provide accurate information
  • Respect privacy of others
  • Use services only for intended purposes
  • Not attempt to compromise system security
  • Report any technical issues or security concerns

B. Prohibited Activities

You may not:

  • Use automated systems to access our website
  • Attempt to gain unauthorized access to systems
  • Upload malicious software or content
  • Use services for commercial purposes without permission
  • Harass or intimidate other users

11. SMS and Email Communications Terms

A. Consent and Subscription

By providing your mobile phone number and/or email address to MYSA-AJAX through registration forms, our website, or to our representatives, you agree to receive communications from us via SMS text messages and/or email. This includes:

Types of Communications:

  • Program updates and announcements
  • Registration reminders and deadlines
  • Game and practice schedules
  • Weather-related cancellations
  • Emergency notifications
  • Marketing communications about programs and events
  • Fundraising campaigns
  • Volunteer opportunities

B. Message Frequency and Charges

Frequency: You may receive approximately 2-4 email messages per week and 1-2 SMS messages per week during active seasons. Frequency may increase during peak registration periods, tournaments, or special events.

Charges: Message and data rates may apply according to your mobile carrier's plan. MYSA-AJAX does not charge for sending messages, but your wireless carrier may charge you for receiving them. Please consult with your mobile carrier regarding any potential charges.

C. Opt-Out Procedures

You may withdraw your consent and stop receiving messages at any time using the following methods:

For SMS Messages:

  • Reply STOP to any text message from MYSA-AJAX
  • Text STOP to our messaging number
  • Contact our office at (209) 236-1800
  • Email us at [email protected]

For Email Messages:

  • Click the "Unsubscribe" link in any marketing email
  • Reply to any email with "UNSUBSCRIBE" in the subject line
  • Contact our office at (209) 236-1800
  • Email us at [email protected]

For Help: Reply HELP to any SMS message or contact our office during business hours for assistance.

D. Consent Modifications

  • You may modify your communication preferences at any time
  • You can choose to receive only essential communications (safety, billing, administrative)
  • You may pause communications temporarily and resume later
  • Different consent levels are available for marketing vs. essential communications

E. Essential Communications Exception

Even if you opt out of marketing communications, you may still receive essential program-related communications including:

  • Safety and emergency notifications
  • Billing and payment confirmations
  • Important administrative updates required for program participation
  • Weather-related cancellations for safety reasons

F. Message Timing

Messages may be sent between 8:00 AM and 8:00 PM Pacific Time, unless emergency or safety notifications require immediate delivery.

G. Liability for Communications

MYSA-AJAX is not responsible for:

  • Delayed or undelivered messages due to carrier issues
  • Charges imposed by your wireless carrier
  • Technical issues with your device or carrier service
  • Messages sent to incorrect numbers due to information you provided

You acknowledge that SMS and email communications are not guaranteed to be secure or private, and you should not include sensitive personal information in your responses.

12. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference, for information about how we collect, use, and protect your personal information.

13. Third-Party Services

Our Services may contain links to third-party websites or services. MYSA-AJAX is not responsible for the content or practices of these third parties. Your use of third-party services is at your own risk.

14. Governing Bodies and Regulations

A. Compliance Requirements

MYSA-AJAX operates under the authority of:

  • California Youth Soccer Association (CYSA)
  • US Youth Soccer
  • FIFA and USSF rules (as applicable)

B. Participant Obligations

All participants must comply with rules and regulations of applicable governing bodies. Violations may result in disciplinary action by both MYSA-AJAX and governing authorities.

15. Communication

A. Official Communications

Official communications will be sent via:

  • Email to registered addresses
  • Posted notices on our website
  • Announcements at meetings or events

B. Communication Preferences

You may update your communication preferences by contacting our office. However, you cannot opt out of essential program-related communications.

16. Force Majeure

MYSA-AJAX shall not be liable for any failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Weather conditions
  • Natural disasters
  • Government regulations
  • Facility unavailability
  • Public health emergencies

17. Indemnification

You agree to indemnify and hold harmless MYSA-AJAX, its board members, coaches, volunteers, and affiliates from any claims, damages, or expenses arising from:

  • Your participation in programs
  • Your violation of these Terms
  • Your violation of applicable laws or regulations
  • Your negligent or wrongful conduct

18. Dispute Resolution

A. Informal Resolution

Before pursuing formal legal action, parties agree to attempt resolution through direct communication with MYSA-AJAX administration.

B. Governing Law

These Terms shall be governed by the laws of the State of California without regard to conflict of law principles.

C. Jurisdiction

Any legal disputes shall be resolved in the courts of Stanislaus County, California.

D. Limitation of Actions

Any claims must be brought within one (1) year of the date the claim arose.

19. Disclaimers and Limitations

A. Service Availability

MYSA-AJAX provides services on an "as is" basis. We do not guarantee:

  • Uninterrupted program availability
  • Specific outcomes or results
  • Compatibility with all individual needs
  • Error-free operations

Website and Information Disclaimer: The information, services, and materials contained on our website, including text, graphics, and links, are provided on an "as is" basis with no warranty. To the maximum extent permitted by law, MYSA-AJAX disclaims all representations and warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, and freedom from computer virus.

Accuracy of Information: MYSA-AJAX does not represent or warrant that information accessible via our website is accurate, complete, or current. Program information, schedules, and pricing are subject to change without notice. Due to the nature of youth sports and changing circumstances, errors can and will occur.

B. Limitation of Liability

To the maximum extent permitted by law, MYSA-AJAX's liability for any claim shall not exceed the amount paid by you for the specific program or service giving rise to the claim.

Communication-Related Liability: MYSA-AJAX shall not be liable for any direct, indirect, special, punitive, incidental, exemplary, or consequential damages arising out of or in connection with SMS or email communications, including but not limited to:

  • Delayed or undelivered messages
  • Carrier charges or fees
  • Technical issues with devices or networks
  • Misdelivered messages due to incorrect contact information
  • Privacy or security issues related to electronic communications

General Liability Limitation: In no event shall MYSA-AJAX be liable for any damages whatsoever, even if MYSA-AJAX has been previously advised of the possibility of such damages, whether in an action under contract, negligence, or any other theory, arising out of or in connection with the use, inability to use, or performance of our services, website, or communications.

C. Exclusions

MYSA-AJAX shall not be liable for:

  • Indirect or consequential damages
  • Lost profits or opportunities
  • Emotional distress
  • Punitive damages

20. Intellectual Property and Content Use

A. MYSA-AJAX Intellectual Property

All content on our website and in our materials, including images, logos, trademarks, text, graphics, and other content, are owned by MYSA-AJAX or used with permission. The images, logos, copy, and trademarks contained on our website may not be used in any manner or for any purpose without MYSA-AJAX's express written permission.

By submitting content to MYSA-AJAX (photos, videos, testimonials), you grant us permission to use such content for promotional and organizational purposes.

21. Amendments and Modifications

A. Right to Modify

MYSA-AJAX reserves the right to modify these Terms, program offerings, fees, and policies at any time with notice to participants.

  • Announcements at meetings

C. Acceptance of Changes

Continued participation after notification of changes constitutes acceptance of modified Terms.

25. Severability

A. Termination by MYSA-AJAX

MYSA-AJAX may terminate your participation for:

  • Violation of these Terms
  • Non-payment of fees
  • Disciplinary reasons
  • Safety concerns
  • Program discontinuation

B. Termination by Participant

Participants may withdraw from programs at any time but forfeit fees as outlined in our refund policy.

C. Effect of Termination

Upon termination, all rights and obligations cease except those that by their nature should survive termination.

26. Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and any additional program-specific agreements, constitute the entire agreement between you and MYSA-AJAX regarding our Services.

28. Acknowledgment

By participating in MYSA-AJAX programs or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
